Terms and Conditions

Thank you for your business and we hope you enjoy your stay in our property!

1. ACCEPTANCE OF PAYMENT ASSUMES ACCEPTANCE OF OUR TERMS
2. Weddings or large events are not permitted at any of our properties.
3. Arrival information instructions, driving directions, and check-in instructions will be sent 3 days prior to arrival via email.
4. Booking guests must be 25 years of age or older.
5. All Guests must adhere and abide by rules and regulations set forth by Innsbrook Corporation at all times.
6. By providing your phone number, you agree to receive text messages from our company. Message and data rates may apply. Message frequency varies.

BASIC TERMS OF THE CONTRACT

ALL PROPERTIES ARE NON-SMOKING
Guests will be fined $500 for violating our non-smoking policy.

PET POLICY
Violation of our pet policy will result in a $500 fine per pet. All pets must be approved to be brought on property.

MAXIMUM OCCUPANCY AND PARKING LIMITS
The maximum number of guests in the unit is limited to the number of persons specified in the property description. One car per bedroom of the property is permitted. Additional vehicles are not permitted unless otherwise specified. To maintain our rental permits we cannot allow RV’s, campers, trailers, or tents at the homes, and the occupancy limit of each home may not be exceeded at any time. This means total occupancy includes non-occupant visitors. If you anticipate having visitors stay with you, we ask that you rent a home with a higher occupancy limit. Additional guests will result in an immediate termination of this rental agreement and forfeiture of all rental fees.

PAYMENT
An advance payment equal to 50% of the total rental rate is required for a deposit to secure your reservation. The advance payment will be applied toward the unit rent. You may pay by credit card using MasterCard, Visa, Discover, or American Express. The advance payment is not a damage deposit. Thirty (30) days prior to arrival 100% of the remaining balance is due. Upon receipt of the full payment amount due, Vacation Management Solutions will email the Guest a final confirmation of the reservation along with driving directions and the Property’s door code/lockbox code THREE (3) DAYS prior to arrival.

CANCELLATION POLICY
Full refund, less a 3% cancellation fee, up to 30 days prior to your arrival date when booked directly through our website. Bookings on separate channels (Airbnb/VRBO/Hometogo) are subject to the cancellation policies outlined on the booking channel.


DAMAGE POLICY
ALL RENTERS must reimburse for all damage to the unit or its contents, beyond normal wear and tear, for charges incurred due to pets or collection of services rendered. Purchased Damage Protection policy covers listed amount below of accidental coverage.
$25 – $200 Worth of Accidental Damage
$30 – $250 Worth of Accidental Damage
$35 – $300 Worth of Accidental Damage
$50 – $400 Worth of Accidental Damage
$75 – $500 Worth of Accidental Damage
$100 – $750 Worth of Accidental Damage
$125 – $1,000 Worth of Accidental Damage
Any Damage resulting in a monetary amount greater than policy coverage above, beyond normal wear and tear, will be the responsibility of each and every guest of your party’s reservation.

HAZARDOUS MATERIALS
Guests shall not bring or keep on the Premises any item of a dangerous, flammable, or explosive character that might unreasonably increase the danger of fire or explosion on the Premises, or that might be considered hazardous or extra hazardous by any responsible insurance company.

TOILET BLOCKAGES
All toilets are checked to ensure proper functioning prior to check-in. Blockages can occur if too much toilet paper, tampons, or sanitary napkins are put into the toilets. If a service call is required to clear a toilet blockage, Guest will be charged the costs associated with clearing the blockage. The minimum service call fee is $25 for toilet blockages. The minimum service call on weekends and holidays is $75.

QUIET HOURS
Between the hours of 10:00 p.m. (CST – Central) and 7:00 a.m. (CST – Central). Quiet Hours exist and are strictly enforced. Guest must be respectful of their neighbors and not disturb the peaceful enjoyment of their homes or the neighborhood. Any occupant or Guest violating this provision of the terms and conditions will be asked to leave immediately. If the Guest’s occupancy is terminated due to violation(s) of this provision, the Guest understands and accepts that no compensation, reimbursement, or refund will be made to the Guest. The Guest agrees to be responsible for the actions of themselves, other occupants, and temporary guests. The Guest agrees to act with decorum and civility at all times and to be responsible for the actions of the Guest’s guests and Vacation Management Solutions retains sole discretion and may terminate the Guest’s occupancy of the Premises if Vacation Management Solutions determines that either the Guest or any member of the Guest’s group has acted inappropriately. In the event that the Guest’s occupancy is terminated due to inappropriate behavior, the Guest understands and accepts that no compensation, reimbursement, or refund will be made to the Guest. Examples of inappropriate behavior include, but are not limited to, disturbing the peace of the neighborhood; willful damage to the property; occupancy by persons not disclosed on the Guest data form; excessive occupancy; violent, aggressive, confrontational, or threatening behavior or conversation; and/or failure to secure/lock the Premises while no responsible member of the Guest’s group is at the home.

CRIME-FREE PROVISION
Guest, occupants, family, invitees, or other persons under the Guest’s control shall not engage in or facilitate: (i) any acts involving imminent or actual serious property damage as defined by law; (ii) any criminal activity, including drug-related criminal activity, any act of violence or threats of violence, other illegal activity, including prostitution, criminal street gang activity, threatening or intimidating unlawful discharge of firearms, or assault; (iii) jeopardize the health, safety, and welfare of guests, Vacation Management Solutions or its representatives, agents or others. VIOLATION OF THIS PROVISION SHALL CONSTITUTE A MATERIAL AND IRREPARABLE VIOLATION OF THIS AGREEMENT AND GOOD CAUSE FOR IMMEDIATE CANCELATION OF THIS AGREEMENT AND SURRENDER OF POSSESSION.


LIABILITY
This agreement dictates that guests or visitors of guests will not hold Vacation Management Solutions LLC or any of the individual homeowners responsible for events such as personal injury, death, or loss of personal property. By renting our properties you and your guests agree to use any pool, hot tub, or body of water at your own risk and assume all responsibility. No lifeguards will be on duty at any of our managed locations. In no instance or circumstance will Vacation Management Solutions, its agent, or affiliated representative be liable for more than the total amount paid by the Guest.

DEFAULT
Guest fails to comply with any of the material provisions of this Agreement, Vacation Management Solutions may, at its option, declare the entire balance of rent payable hereunder for the remainder of the Rental Term to be immediately due and payable, and may exercise any and all rights and remedies available to Vacation Management Solutions at law or in equity, or may immediately terminate this Agreement. If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Premises, remove all Guest’s property and belongings and leave the Premises in good order and free of damage. No refund of any portion of the Rent or Deposit shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred, including, but not limited to, attorneys’ fees and collection costs. In the event, Guest violates the Condition and Use of Premises above, or law enforcement visits the Premises, Vacation Management Solutions may, in its sole and absolute discretion, evict Guest and Guest shall surrender the Property and remove Guest’s property and belongings and leave the Premises in good order and free of damage in an expeditious manner. In addition to the above remedies, in the event that Guest breaches this Agreement, Vacation Management Solutions may perform a non-judicial lockout of the Premises and retake possession.

NOTICES
Any notice required or permitted under this Agreement or under state law shall be delivered to the Guest at the address provided at the time of booking.

DISCLAIMER
We reserve the right to refuse to rent to anyone. All prices are subject to change without notice. We reserve the right to cancel a reservation at any point and time without notice. We do not rent to pets unless otherwise specified. We do not rent to service animals unless otherwise specified. We rent our vacation homes to adults only, over the age of 25. No teen or college parties are allowed. Violators will be asked to leave immediately without a refund. All of our homes are individually owned, amenities are subject to change at any time. No refunds or discounts for appliance malfunction or amenity changes.
